Nova Dimensão da (Des)Igualdade a Partir de Consequências Climáticas: e a Necessidade de Levar a Sério a Esfera Jurídico-Municipal

As consequências dos fenômenos climáticos são destaques no âmbito internacional, principalmente quando causam grandes prejuízos de toda a ordem. As sociedades mais afetadas são aquelas despreparadas para enfrentarem a força climática e catástrofes. O impacto sócio-financeiro ocasionado faz com que ocorra um deságio no que toca a estrutura da sociedade atingida, constituindo-se um novo fator de desigualdade entre os grupos sociais. No âmbito estatal, encontra-se no Brasil um sistema federativo em que o ente municipal acaba por absorver os problemas exsurgentes com os munícipes, porém os recursos financeiros municipais não são suficientes – na perspectiva da divisão constitucional – para cumprir todas as suas competências e, ainda, enfrentar as consequências dos fenômenos climáticos. Isso estabelece um fator de desigualdade no seio do Estado federal e retira, de fato, a autonomia municipal, pois o torna dependente de recursos financeiros da União e dos Estados-membros, além de tornar menos eficiente a resposta do Estado para os problemas ocasionados pela catástrofe.Downloads
