O presente artigo tem como objetivo analisar a obra ‘Teoria Geral do Estado’ de Gerog Jellinek, buscando em seus fundamentos apontar as principais contribuições do referido autor ao Direito Internacional. Assim, parte-se da explicação da Autolimitação do Estado, segundo a qual o próprio Estado delimita o seu campo de ação por meio de regras jurídicas, as quais são criadas pelo Estado e para o Estado. Uma vez estabelecida a base de sua tese, na sequência do texto explora-se os reflexos da autolimitação do Estado para a teoria do Direito Internacional, primeiramente em relação ao fundamento voluntarista das regras de Direito Internacional, diferenciando-se do posicionamento jusnaturalista até então dominante; e, posteriormente, no que tange a sua posição monista com primado no Direito Interno enquanto base para compreender as relações entre o Direito Internacional e o Direito Doméstico. Para tanto, por meio do método dedutivo, realiza-se por meio desse escrito uma análise minuciosa da referida obra, trazendo, quando necessário, outros aportes doutrinários para fundamentar as explicações de Jellinek no que diz respeito à sua visão do Direto Internacional em relação ao Estado soberano.Downloads
