O afeto é indispensável para a convivência familiar no que tange à paternidade responsável, visto que o rebento deve ser amparado moral e materialmente. Conforme análise jurisprudencial, o não cumprimento deste princípio poderá causar danos aos filhos que alimentam a perspectiva de serem criados e assistidos por seus pais. Nessa esteira, o pai ou mãe que abandona o filho responderá por sua negligência diante do Estado conforme previsão legal. Quem quer seja, causar dano a outrem está obrigado a reparar, a fim de minimizar os prejuízos sofridos e também como forma punitiva e dissuasória, para que outros não cometam o mesmo erro. A indenização por abandono afetivo parental não se trata de obrigar alguém a amar, mas de reparar lesão sofrida pelo bem jurídico protegido, qual seja a vida. Nessa perspectiva, diante da problemática, a qual busca-se verificar os requisitos utilizados por julgadores em demandas referentes à indenização por abandono afetivo parental, mediante exame bibliográfico, fazendo análises jurisprudenciais e doutrinárias, ficou evidenciado na pesquisa que o entendimento do Supremo Tribunal de Justiça é de que se admite indenização por violação do dever de cuidado, porém, não se admite indenização por violação do afeto. A violação pura e simples deste não gera indenização, o que pode ensejar, é indenização pela falta do dever de cuidado, nunca o dever de afeto.
